Terms and conditions

  1. Your mBooked.com Account

    By creating an event on the Portal, you are taking the responsibility for providing and maintaining security of your account and event, also for all activities which may occur under the account and all action taken in connection with the event. Using description or keywords of your event in inappropriate, unlawful or misleading manner is strictly not allowed, this includes intention to trade on the name or reputation of others. If this occurs mBooked.com may change or remove any description or keyword which it considers as unlawful or inappropriate, or otherwise may cause mBooked.com liability. All unauthorized uses of your event, your account or any other breaches of security must be reported to mBooked.com immediately. mBooked.com will not be liable for any acts or omissions by you, including any damages of any kind sustained by such acts or omissions. Informing buyers that they have bought tickets from mBooked.com and should claim a refund for the purchased tickets from mBooked.com will result in immediate penalty actions, including removal of their promoter account.

  2. Payments

    Thanks to magic Stripe API all funds are going directly to the promoter Stripe account. The whole process is 100% automated. We don’t hold any of your money from your tickets. Transfer takes 1 week to send funds from Stripe to your bank account. The ticket seller can decide who pays for Stripe fees.

    • EUR 0.55 + 5.4% or 0.30 + 4%
    • UK 0.40 + 6.4% or 0.10 + 5%
    • USA 0.60 + 6% or 0.30 + 3.1%
    • POLAND 1.20 + 5.4% or 0.20 + 4%

    * Stripe fee EUR 1.4% + 0.25 EUR.
    * Stripe fee UK 1.4% + 0.20 GBP.
    * Stripe fee USA 2.9% + 0.30 USD.
    * Stripe fee POLAND 1.4% + 1.00 PLN.

    If you choose to add Stripe fees from the buyer, the final value may vary slightly. We calculate this charge before the transaction takes place. We use the calculations exactly the same as on Stripe’s official website, but it is a matter of rounding amounts or paying with a card in another currency. The exact value is available in our sales report.

  3. Content posted on other Websites

    We are not reviewing any material, including computer software, which is available on other websites/web pages to which mBooked.com links and which are linked to mBooked.com. We do not have control over those non — mBooked.com websites/web pages and are not responsible for their content and use. When linking to a non — mBooked.com websites/web pages you should remember that we do not represent or sign under such websites/web pages. It is your responsibility to provide security and to protect yourself and your computer from viruses, worms, Trojan Horses, and all other harmful or destructive content. We are not responsible for any harm, loss or problems which may occur from your use of non — mBooked.com websites/web pages.

  4. Copyright Infringement

    We do respect the intellectual property rights of others all the time and at the same time we ask others to respect our intellectual property rights. In the case you notify that material located on or linked to mBooked.com infringes your copyrights, you should contact us immediately in accordance with our Copyright Policy. If this occurs we will respond as soon as possible, and this if needed may apply by removing the infringing material or disabling all links to it. If the visitor is found to be a repeat infringer of the copyrights or other intellectual property rights of mBooked.com or others, we will block their access to and use of the website. In such cases mBooked.com will not be obliged to make refunds of any amounts previously paid to mBooked.com.

  5. Privacy policy

    There are two possibilities to use mBooked.com :
    As a participant, if you sign up for an event hosted on mBooked.com.
    As the organizer, if you use mBooked.com to manage the event.

    Participant Policy:

    Cookies are used to track page views and browser statistics. This information is provided to the event organizer to give them information about the number of people viewing their event. Additionally, organizers are allowed to use tracking services such as mBooked.com for the organizer to track conversions after registration. Information about participants are never shared with any third party, only registration information is provided to the event organizers. We can use your e-mail address for futher marketing actions, but we will not share with third party.

    Organizer Policy:

    Cookies are used to allow authenticated login to the event management software. They are not used to track personal information, preferences, or other information and are only used to store the logged in state. After the registration by Organizer is completed, the cookie is configured to last for 1 year without asking for credentials again. We never agree to share information about the organizer with any third party without organizers consent. For support purposes only, our employees and contractors have the ability to take control of any organizer’s account. Passwords are stored using one way encryption, which cannot be retrieved. For our own internal statistic use, from all events we collect revenue figures, ticket numbers and overall event numbers.

    Please note that we will save an email to each person who will fill in the form to purchase the ticket, accept terms and conditions and click the pay now even if the payment process is not completed. In order to delete a given email please contact us at gdpr@mbooked.com.

  6. YOUR RIGHTS TO YOUR PERSONAL DATA

    You have several rights in relation to your personal data and our use of it. If you would like to make a request for any of the following detailed rights, you can write us by emailing hi@mbooked.com. The below is a summary of your rights according to our interpretation of the GDPR;

    • The right to be informed: Our privacy policy and website terms at the time of capturing your personal data disclose how we are using your personal data.
    • The right to access: You have the right to access the personal data we process and other information such as purpose of processing, who your data has been or will be disclosed with etc. In most cases this is free of charge, there may be some charges if the request is excessive and requested numerous times.
    • The right to rectification: You can ask for the rectification of your personal data if you believe the data in our possession is inaccurate.
    • The right to removal: We are obligated to remove your personal data from our records without undue delay if you request its removal. If it’s not possible for us to remove your personal data from our records or we need to retain your personal data we will inform you why we cannot process your request.
    • The right to data portability: You can request a copy of your personal data in a machine-readable format and have the right to transmit the data to another controller.
    • The right to restrict object/processing: You have the right to block or suppress processing of your personal data or right to withdrawal of your consent
    • Rights of automated decision making and profiling: You can choose not to be the subject of a decision where the consequence is based on automated processing

  7. Refunds

    Each organiser has the right to establish their own refund rules, including no refund, and this must be clearly stated in the event description. If they do not do so each ticket buyer has 72 hours to apply for a refund to the organizer of the event. The organizer of the event has 7 days to complete the refund order. The 7-day period does not take into consideration the time of transfer of funds. If the refund is not made within the deadline, mBooked.com has the right to make it on behalf of the event organizer and take disciplinary action against the organizer, including removal of his promoter’s account. In case of cancellation of the event, the organizer must return all money from the tickets (Stripe and mBooked.com fees are not refundable).

    The portal Publisher is not legally liable and is not obligated to any compensation to the ticket holders for any changes or cancellation of the event, if those changes are due to circumstances above our control (mentioned by Organiser), also such as random accidents, illness of the artist, bad weather conditions, flights schedule changes, etc.
